These Terms of Service (“Terms”) govern your access to and use of ABSM Protein Intelligence. Please read them carefully — by using the Service you agree to them.
ABSM Protein Intelligence is a commercial decision-support and market-information tool. It is not investment, trading, brokerage, hedging, tax, or legal advice, and its forecasts, signals, and buy/sell indicators are probabilistic estimates, not guarantees. You are solely responsible for your own procurement, pricing, and business decisions. Never rely on the Service as the sole basis for a transaction.

01Who we are & acceptance
ABSM Protein Intelligence (the “Service”) is operated by American Beef Sales & Marketing LLC (“ABSM,” “we,” “us,” or “our”). By creating an account, subscribing, or otherwise accessing the Service, you agree to be bound by these Terms and by our Privacy Policy. If you are using the Service on behalf of a company or other organization, you represent that you are authorized to accept these Terms on its behalf, and “you” refers to that organization. If you do not agree, do not use the Service.
02The Service
ABSM Protein Intelligence provides daily and weekly beef and pork market intelligence, including price data, cutout and primal values, trade-volume metrics, fundamental indicators, statistical forecasts, buy/sell signals, and periodic market reports. The Service is built primarily on publicly available USDA Agricultural Marketing Service (AMS) Market News data, combined with our own models and commentary.
We may add, modify, or discontinue features, data feeds, plans, or the Service as a whole at any time. Some data may be delayed, revised, or restated by its original source after publication.
03Not investment or trading advice
The Service is provided for commercial protein procurement decision-support and general information only. Nothing in the Service constitutes, and it should not be relied upon as, investment advice, trading advice, a recommendation to buy or sell any commodity, security, or futures contract, hedging advice, or any tax, accounting, or legal advice. ABSM is not a registered investment adviser, commodity trading advisor, broker, or fiduciary.
Forecasts, signals, and indicators are estimates derived from historical data and statistical models. Markets are volatile and influenced by many factors outside any model. Past performance and back-tested results do not guarantee future results. You are solely responsible for evaluating the information and for any decisions or transactions you make. You should consult your own qualified advisors before acting.
04No warranty on data or forecasts
The Service, including all data, forecasts, and reports, is provided “as is” and “as available.” While we take reasonable care, we do not warrant that the information is accurate, complete, current, uninterrupted, or error-free, or that any forecast or signal will prove correct. Source data may contain errors, gaps, or delays, and may be revised by USDA or other providers. You use the Service and rely on any figure at your own risk.
05Subscriptions, billing & renewal
The Service is offered on free and paid subscription plans (for example, a free tier, a paid Trader Desk plan, and an Enterprise plan). Plan features and prices are described at the point of sign-up and may change over time.
- Payment processor. Paid subscriptions are billed through Stripe, our third-party payment processor. By subscribing you also agree to Stripe’s terms. We do not receive or store your full card number.
- Recurring billing. Paid plans are billed in advance on a recurring basis (e.g., monthly) and automatically renew for successive periods at the then-current price until you cancel. You authorize us and Stripe to charge your payment method for each renewal.
- Price changes. We may change subscription prices. Any change applies to the next billing period after we give you reasonable advance notice; continuing your subscription after the change means you accept the new price.
- Taxes. Stated prices may not include applicable taxes, which may be added where required.
- Failed payments. If a charge fails, we may retry, suspend, or downgrade your access until payment is resolved.
06Cancellations & refunds
You may cancel a paid subscription at any time through your account or by contacting us. Cancellation stops future renewals; your paid access continues until the end of the billing period that is already paid for. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods, unused access, or downgrades. We may, at our sole discretion, offer a refund in individual cases.
07Accounts & access
You must provide accurate information and keep your account credentials confidential. You are responsible for all activity under your account. A subscription is licensed for use by a single subscriber or the named organization; unless your plan expressly allows multiple seats, you may not share login credentials. Notify us promptly of any unauthorized use.
08Acceptable use & license
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own internal business purposes. You agree that you will not:
- resell, sublicense, redistribute, republish, broadcast, or make the Service’s forecasts, signals, reports, or data available to any third party, whether free or for a fee;
- scrape, harvest, or use automated means to extract data from the Service beyond features we expressly provide;
- copy, frame, or mirror any part of the Service, or use it to build or train a competing product or model;
- reverse engineer, decompile, or attempt to derive our models or source code;
- circumvent access controls or usage limits, or share paid access outside your plan;
- use the Service unlawfully or in a way that harms, overburdens, or disrupts it.
Our market reports and analysis are for your internal use; forwarding an occasional report to a colleague within your organization is fine, but systematic redistribution is not.
09Intellectual property
The Service — including our models, methodology, analysis, commentary, forecasts, signals, software, design, and the “ABSM Protein Intelligence” and “American Beef Sales” names and marks — is owned by ABSM and protected by intellectual-property laws. We reserve all rights not expressly granted. The underlying USDA source data is U.S. Government public information; our compilation, presentation, and analysis of it are ours.
10Third-party services
The Service relies on third parties, including Stripe for payments and Cloudflare for hosting and delivery, and on public data from USDA AMS Market News. Your use of those services through the Service may also be subject to their terms and policies. We are not responsible for third-party services, and their availability or accuracy is outside our control.
11Suspension & termination
We may suspend or terminate your access, with or without notice, if you breach these Terms, if your payment fails, or if we reasonably believe your use poses a risk or is unlawful. You may stop using the Service at any time. On termination, your license ends; sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.
12Disclaimers
To the fullest extent permitted by law, the Service is provided without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any result, forecast, or signal will be achieved. See also Sections 3 and 4.
13Limitation of liability
To the fullest extent permitted by law, ABSM and its members, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost revenue, lost or missed savings, trading or procurement losses, or loss of data or goodwill, arising out of or relating to the Service or these Terms, even if advised of the possibility. In all cases, our total aggregate liability arising out of or relating to the Service will not exceed the greater of the amount you paid us for the Service in the three (3) months before the event giving rise to the claim, or US $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
14Indemnification
You agree to defend, indemnify, and hold harmless ABSM and its members, officers, and employees from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or third-party right.
15Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, for material changes, take reasonable steps to notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
16Governing law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. You and ABSM agree to the exclusive jurisdiction of the state and federal courts located in Illinois for any dispute not subject to another agreed process, and to venue in those courts.
